Chapter 15.04: BUILDING AND LAND USE PERMITS
15.04.010 Permits for building, altering or improving.
No structure of any kind shall be built, enlarged, altered, replaced, removed, constructed, placed and/or located in the town without a building permit. Said
building permit to be approved by the town manager and obtained through Frederick County department of permits and inspections. All building permits shall adhere to the state
building code as administered by the county of Frederick. All applications must be signed by the owner of the premises or his authorized representative or agent and shall
have his/her address and/or lot number written under his/her signature (Ord. 02-01 (part): Prior code Art. XI § 1)
15.04.020 Permits for use of land and buildings.
The use or uses to which land and/or buildings in the town is or are put as of May 1, 1961 shall not be changed without a permit. Said permit must be approved by the
town manager. Said permit must be signed by the town manager. Blank forms for applications for permits shall be furnished at the town office for all persons applying for the same. All applications must be signed by the owners of the premises or his authorized representative or agent and shall
have his address and/or lot number written under his signature. (Ord. 02-01 (part) Prior code Art. XI § 2)
Chapter 15.08: NUMBERING OF BUILDINGS
15.08.010 Number required.
Prior to the issuance of any use and occupancy permit, each building shall be identified by the use of Arabic numerals or such numerals and a letter suffix with a number as designated by the town clerk, which number shall be affixed
to the building in characters at least three inches high and at least one-half inch in width and of a color and/or finish sufficiently contrasting with the building as to be clearly visible and legible in both the daytime and nighttime from the street. Such number shall
thereafter be maintained, and, if necessary, replaced from time to time so as to comply at all times with the requirements of this section. (Ord. 95-2 § 1(12.1); prior code Art. XI § 12.1)
15.08.020 Notice.
When a building is found within the town which does not have the numbering stipulated in Section 15.08.010, the owner of the property shall be notified that he or she is required to install such numbering within fifteen (15) days of
receiving such notice. (Ord. 95-2 § 1(12.2); prior code Art. XI § 12.2)
15.08.030 Violation—Penalty.
In the event that the owner does not properly number the building within fifteen (15) days from the date of receiving the notice set forth in Section 15.08.020, the owner of the property will be in violation of this chapter. A
violation of this chapter shall be a municipal infraction, the penalty, for which shall be twenty-five dollars ($25.00). Each day such violation shall occur shall be another violation of this chapter. (Ord. 95-2 § 1(12.3); prior code Art. XI § 12.3)
Chapter 15.10: BUILDING STANDARDS-FIRE PROTECTION
15.10.010 Adoption of Maryland Building Performance Standards
Subject to the amendments and modifications set forth in this chapter, the Maryland Building Performance Standards (MBPS), Code of
Maryland Regulations (COMAR), Sections 05.02.07 et seq., as they may be amended from time to time, are adopted by and for the town of
Emmitsburg and they are incorporated by reference in this chapter. (Ord. 05-05 (part))
15.10.020 Requirement for fire sprinklers in newly constructed buildings.
The MBPS regulations are modified to require that all one- and two-family dwellings for which a zoning certificate is issued after
the effective date of the ordinance codified in this chapter shall be equipped throughout with an automatic sprinkler system designed
and installed in accordance with Section 903.3.1.3 for group R-3 and in accordance with Section 13.5.2 of the NFPA Uniform Fire Code,
2003 Edition. (Ord. 05-05 (part))
15.10.030 Modifications to International Residential Code
The International Residential Code (adopted and incorporated in the Maryland Building Performance Standards, COMAR, Sections
05.02.07 et seq.), is modified for one- and two-family dwellings, as follows:

Section R313 is re-titled "Fire Protection"."

The following is added as Section R313.3:
R313.3 Automatic sprinklers: An automatic sprinkler system designed in accordance with the National Fire Protection
Association's Standard 13D, as may be amended from time to time and which is incorporated by reference in the State Fire
Prevention Code (COMAR29.06.01), shall be installed in all one (1) and two (2) family dwellings after receipt of a zoning
certificate and prior to the issuance of a use and occupancy permit. (Ord. 05-05 (part))
15.10.040 Applicability of requirements
-
The requirements for automatic sprinkler systems as set forth in this chapter shall apply
to:
-
Any one- or two-family dwellings which is constructed on a lot and for which a zoning
certificate has not been issued as of the effective date of the ordinance codified in this chapter, and
-
Any one- or two-family dwelling which is constructed as a replacement for a dwelling
which has been razed.
-
These requirements shall not be applicable to any one- or two-family dwelling in
existence on the effective date of the ordinance codified in this chapter or to any such dwelling which is refurbished, renovated,
or altered after the effective date of the ordinance codified in this chapter. (Ord. 05-05 (part))
15.10.050 Technical assistance from the office of the state fire marshall
Unless otherwise agreed, the office of the state fire marshal, shall provide technical assistance to the town of Emmitsburg by way
of plan review and inspection services for all fire sprinkler systems installed pursuant to the requirements of this chapter. (Ord.

15.10.060 Invalidity of any provision
If any section, subsection, sentence or clause of this chapter is held for any reason to be invalid, such decision or decisions
shall not affect the validity of the remaining portions of this chapter. (Ord. 05-05 (part))
Chapter 15.12: PLUMBING CODE
15.12.010 State regulations adopted.
The plumbing regulations of the state of Maryland, "State Plumbing Regulations," are made a part of the Code of Emmitsburg. (Prior code Art. XII § 18)
